MLBPA initiates NIL lawsuit against DraftKings, FanDuel, and other sports betting corporations
The MLB Players Association initiated a legal action against four sports betting companies on Monday, alleging that these entities were not authorized to utilize the names and likenesses of players for their own brands.
The lawsuit primarily targets DraftKings and FanDuel, with players also seeking compensation and punitive damages from bet365 and Underdog Fantasy. DraftKings and bet365 are being sued in federal court in Philadelphia, while the other two sportsbooks are facing legal action in New York state court.
The MLBPA is accusing the sportsbooks of violating state laws that are meant to protect players in the public eye. Players' images have been prominently featured on sports betting websites and mobile apps, which the MLBPA believes could be misleading to users who may think that the players endorse gambling on games.
According to the players, the ability to control the commercial use of their names, images, and likenesses is a crucial aspect of their career investment.
ESPN has reported that bet365 was not available for comment after business hours, while the other three sportsbooks have yet to respond.
